Duska (1997) objects to this approach in which whistleblowing is primarily framed as an act of disloyalty, one that needs justification or that can be pursued only under special circumstances. It is, writes Duska, “as if the act of a Good Samaritan is being condemned as an act of interference, as if the prevention of a suicide needs to be justified “ (p. 335).

The potential WB-er should try to assess the likelihood that external whistleblowing will actually do some good. That is the point of T3. If whistleblowing probably won't do any good, perhaps one shouldn't blow the whistle even if T1, T2 and T4 are met.

There have been many other examples of whistleblowing and with the introduction of the False Claims act of 1986 has caused many people to come forward to report financial or sexual improprieties carried out by people of considerable power. The whistleblowers know that under this Act they are entitled to the protection of the US Government, and if their claims are proved to be correct, their public spirited acts will help to stem the abuse of privilege.
Inhouse and/or external legal counsel will be needed to ensure that the legal aspects of the whistleblowing policy are fully considered in the establishment phase. Counsel should ... be involved in any investigation, in response to a concern raised, of possible illegal acts or criminal offences.
