The EU Transport Council meeting in December 2005, responded cautiously to the draft agreement reached by European Commission and US negotiators in November 2005 on a phased ‘open skies’ deal aimed at liberalising transatlantic air services. The draft agreement – if approved – would represent an important step towards the normalisation of the air transport industry and a first step towards the creation of a transatlantic open aviation area. However, significant hurdles remain. While there was unanimous Council agreement that ’substantial progress’ had been achieved in the latest round of talks in Washington, transport ministers expressed concern about a lack of clarity in relation to the US Department of Transportation’s (DOT) notice of proposed rulemaking (NPRM) – published in November 2005 – relating to foreign control of US airlines.
