'The Angry Penguins' was a modernist literary and artistic movement that sought to shake up the entrenched art establishment of Australia in the 1940s. The movement was run by a group of passionate and 'angry' young men - the rebels of their day. Centred around poet Max Harris, the movement took their name from an art and literary magazine first published by Harris in 1940.

Coming off the success of "Earth Angel," the Penguins approached Buck Ram to manage them. Ram's primary interest was in managing the Platters, who at that point had no hit singles, but were a profitable touring group. With the Penguins in hand, Ram was able to swing a 2-for-1 deal with Mercury Records, in which the company agreed to take on the Platters as a pre-condition for getting the Penguins (the group that Mercury really wanted)

After the Penguins filed for bankruptcy in October 1998, Lemieux assembled a group of investors who submitted a reorganization plan to a U.S. bankruptcy judge in March 1999. The plan was confirmed in June and -- after several months of negotiations with partners and vendors -- received final approval in September.
