In the instructions issued by the Social Security Administration to its field offices, forensic patients who have been officially released from confinement in an institution, may have their benefits reinstated. Forensic patients who are part of a conditional release program and whose "basic living needs" are no longer being maintained by the institution will ... have their benefits reinstated. The instructions clearly indicate that basic living needs do not include continued treatment of medical care. Also, a patient will not be considered in continued confinement if that patient resides in a group home subsidized by the state mental health agency.
