The idea is (and Jackson has stated) that people are supposed to assume that Saruman has been defeated. whether or not he is dead is irrelevent, but the fact that his regime has been overthrown and Isengard has been destroyed (the end of the second film) is supposed to be concrete enough to show that he has been defeated.
