Stack seeks an injunction ordering Trooper Perez to refrain from offering false testimony under oath in the future. While his complaint contains no allegations that Trooper Perez is likely to perjure himself in the future, in his papers opposing the instant motion, Stack claims that "Trooper Perez has previously demonstrated a willful disregard for the laws against perjury, and, without such injunctive relief, there is no safeguard that he would not do so again." Pl.'s Opp'n. Mot. Dismiss at 7. He further argues that the "facts surrounding . . . Officer Perez's attempts to have the restraining order rescinded demonstrate that the plaintiff is in danger of sustaining bodily injury if Trooper Perez is allowed to continue his perjurious ways."
