On May 4, 2001, Blake took Bakley to an Italian dinner at Vitello's Restaurant on Tujunga Avenue in Studio City. Afterward, Bakley was murdered by a gunshot to the head while sitting in the car, which was parked on a side street around the corner from the restaurant. Blake told the police that he had gone back to the restaurant to get a gun he left at the table and was there when the shooting occurred. When questioned later, no other diners or employees recalled Blake returning to the restaurant.

Prosecutors say that Blake had plotted Bakley’s murder for some time. She was slain outside a popular Italian eatery, Vitello’s, in Los Angeles on May 4, 2001. According to the five-page complaint, Blake first began scheming two months prior to Bakley’s death. He approached two different people to perform the murder either at Vitello’s or in the Arizona desert. It is believed that when Blake couldn’t convince either of the men to pull the trigger, he did it himself. As reported in the complaint, Blake drove Bakely to the restaurant and parked more than a block away near a dumpster at a construction site.

Blake had a handgun in his possession, but it was not the murder weapon and he had no signs of gunshot residue on his hands. The murder weapon was found a few blocks away in a dumpster. It was not registered to Blake. He maintained his innocence throughout the year-long investigation into the case, but was arrested and charged with her death.

On April 22, Blake was charged with one count of murder with special circumstances, an offense eligible for the death penalty. He was ... charged with two counts of solicitation of murder and one count of murder conspiracy. Blake pled not guilty to all charges. Caldwell was charged with a single count of murder conspiracy and also pled not guilty.

Jurors considering murder charges against actor Robert Blake resumed their deliberations Wednesday. The panel met for 5 1/2 hours on Tuesday, their second full day of deliberations, without asking any questions or requesting any review of testimony.
