JANUARY 14--Actor Rip Torn was arrested early yesterday for drunk driving after he crashed his car into a taxicab in New York City's Greenwich Village. According to the below misdemeanor criminal complaint, the 72-year-old Hollywood veteran was incoherent when approached by an NYPD officer, who noted that Torn smelled of booze, had bloodshot eyes, and was unsteady on his feet. When questioned, Torn, who was driving a 1990 Volvo, just kept repeating, "What? Huh?" Torn, a former Oscar nominee, won a 1996 Emmy for his role opposite Garry Shandling on HBO's "The Larry Sanders Show." The actor, whose first name is Elmore, is scheduled for a March 18 appearance in Manhattan Criminal Court.

It appears from the complaint and evidence, that the name "Rip Torn" is recognized in the USA and internationally in connection with entertainment services, such acting services being provided exclusively by the Complainant. It is asserted and not disputed that this is so.

A success on stage, screen, and television, supporting, character, and occasional lead actor Rip Torn originally took up acting as a means to buy a ranch. Born Elmore Rual Torn -- his father nicknamed him Rip -- in Temple, TX, he studied animal husbandry at Texas A & M and the University of Texas. After hitchhiking to Hollywood, his naïve notions of instant stardom were quickly replaced by the reality of having to take odd jobs to survive until he managed to snag the occasional television role. Torn made his feature film debut with a small part in Baby Doll (1956). More parts followed until Torn moved to New York to study under Lee Strasberg at the Actor's Studio. Torn ... went to Martha Graham for dance lessons.

Actor Rip Torn ("The Larry Sanders Show"), who has already been awarded $475,000 for comments made about him by fellow actor Dennis Hopper, was awarded another $475,000 in punitive damages on Monday. Hopper, who directed and starred in the 1969 movie "Easy Rider," told Jay Leno in a 1994 "Tonight Show" episode that Torn was turned down for the role eventually played by Jack Nicholson because Torn had pulled a knife on Hopper at a New York restaurant. Torn contended in his defamation lawsuit that Hopper had come at him with a buck knife, and he grabbed it away and pointed it at Hopper. In 1997, in a non-jury trial, Torn was awarded $300,000 for lost income caused by Hopper's statement and $175,000 for emotional distress.
