Regulations, like any other form of coercive action, have costs for some and benefits for others. Efficient regulations may only be said to exist where the total benefits to some people exceed the total costs to others.

The 2007-2008 SCDNR Rules and Regulations brochure is printed after the end of the legislative session, but prior to some late legislation or regulation changes and is provided for information only. Changes will be publicized in local newspapers and on the DNR’s web site as new legislation is passed. Any discrepancy between the brochure and any statute or regulation shall be governed by the statute or regulation. Also, errors sometimes appear in this brochure and news releases are published to clarify these situations.

For the first time, a federal agency is authorized to enforce national risk-based security regulations utilizing nineteen categories of performance standards to ensure that chemical facilities assess vulnerabilities and implement detailed plans to address them. Equally important, DHS has clear authority to inspect these facilities and apply strong penalties, including facility shutdowns, for those that fail to act.

"These misguided regulations reveal a total lack of understanding on the FCC's part about how the multifamily video market actually works," said Jim Arbury, NMHC/NAA's Senior Vice President of Government Affairs. "Exclusive access contracts were the primary means through which apartment owners could force the large cable firms to lower their prices and improve their service offerings. By taking this bargaining tool away from owners, the FCC has essentially removed a key incentive the cable firms had to negotiate with apartment owners."

These Regulations prescribe what matters shall be provided for in the documents constituting a Restricted Scheme. The Regulations do not seek to be prescriptive as to how those matters must be dealt with. The intention of the Regulations is to ensure all material particulars relating to a scheme and its operation are disclosed to potential investors.
