The Nutrition Labeling and Education Act has been an important step in increasing public access to nutrition information. An estimated 96 percent of processed foods carried nutrition labels as of 1995.8 In addition, consumers are using the information: nearly three-quarters of the U.S. population age 18 and over report reading food labels.9 The percentage of those who use the label "often" increased from 43 percent in 1994 prior to enactment to 56 percent in 1995 after enactment.10 Thirty percent of respondents of a 1991 survey reported changing their minds about buying food products after reading the nutrition label;11 in a survey conducted in 1997, 61 percent of respondents reported doing so.12
The Nutrition Labeling and Education Act of 1990... known as NLEA, brought about the requirement for nutrition labeling to be carried on most foods. It also allowed for nutrient content claims (example: Low Fat) and FDA approved health claims. Nutrition labeling is required for all foods with a nutrient content claim or health claim. All food products marketed after May 1994 must bear nutritional labeling unless the food qualifies for an exemption.
The Nutrition Labeling and Education Act of 1990 (the Act) amends the Federal Food, Drug and Cosmetic Act (FDC Act). In summary, the most important changes to the FDC Act are a: follows:
"Although the Court ruled against the City of New York, we consider it a win overall because the court clearly recognized the right of state and local governments to require nutrition labeling for restaurants. At least 14 states and three major cities have passed or are considering nutrition labeling for restaurants. Today's court ruling offers clear guidelines for them to follow.
FDA did note that, due to acceptable compliance levels at store level, nutrition labeling for the top 20 fruits and top 20 vegetables will remain a voluntary program. Industry suppliers and retailers are encouraged to incorporate the new nutritional values into signage and packaging so they can comply with the final rule.
