The future of Napster is once again in doubt. A federal judge has ordered the online music file-sharing service to block access to copyrighted material in its vast archive, using lists of songs provided by the large recording companies that sued Napster for copyright infringement. But whether or not Napster's archive of downloadable MP3's will fade into history, the debate over peer-to-peer networking programs like Napster is far from over. While supporters of Napster and similar programs maintain that they are simply sharing personal files, many of the copyright owners strongly believe that "sharing" these files via Napster is "stealing" by another name.

Napster was an instant hit. On June 1 of last year, to test the beta version of the software, Shawn gave it to some 30 friends he met through online chat rooms--on the condition that they not spread the word. Other features include a recommendation engine, which suggests content based upon each individual's taste, and dual delivery, which makes sure that - when content is purchased on the phone - a copy is sent to the customer's PC.

Napster's reluctance to come to grips with the statutory language is understandable, because the activities of Napster's users do not even arguably come within the terms of the statute. Not only does the language of Section 1008 foreclose Napster's immunity defense, but it does so in four separate and independent ways. Napster's argument ... depends on a wholesale disregard of what Section 1008 actually says.
