As Napster and the RIAA head back into court today, industry and legal analysts have no idea what the 9th U.S. Circuit Court of Appeals will decide. Napster and RIAA lawyers will have 20 minutes each to present their arguments on why the stay of Judge Marilyn Patel's earlier decision to shutdown the service should be continued or removed. The Recording Industry Association of America wants Judge Patel's injunction against Napster reinstated because “this service is causing serious injury to songwriters.” Napster's lawyers say that the service is protected by previous legal decisions that Judge Patel ignored and that RIAA lawyers misrepresented. Once the two sides get to speak, the judges are expected to take about a month to make their decision.

Dug up by Tara Calishain: At 1:19am, Napster put a press release out on the wire making public the business plan they’ve been building for the past six months. “The proposal would provide guaranteed revenue of $1 billion to the major labels, songwriters and independent labels and artists over the next five years.”

Napster does allow you to import MP3s and other digital music. Napster does not monitor, review, or even look at imported songs. It’s your responsibility to make sure that all the music you have is legal.
