In 1934 Mary was sued by her father for non support. Despite the enormous financial aid she had given her parents over the years, the court ordered her to pay them a weekly allowance. Then, in 1935, Franklyn Thorpe filed for divorce from Mary, citing adultery with George Kaufmann and others. Mary had kept a diary from 1929 through 1934, and this was introduced by her husband as evidence in the fight for custody of daughter Marylyn. In the meantime, Astor's marriage to Franklyn Thorpe continued to deteriorate. She learned from Kaufman that Thorpe had talked to him about their affair. When the inevitable confrontation came, Thorpe told her he would name Kaufman in a divorce suit. He said that if she would let him take their daughter, Marylyn, she could have her back after six months to keep for six months. She believed that later on she could get custody of Marylyn and avoid bad publicity.

A tattling nurse produced by Miss Astor named four women who at various times after the divorce had apparently spent the night with Dr. Thorpe. One of these, a blonde onetime showgirl named Norma Taylor*, was ... recalled by a Los Angeles policeman. Dr. Thorpe had summoned him in after Miss Taylor, intoxicated, had invaded his dining room when he was eating with his daughter, brandished a candlestick, chased him upstairs, cornered him in a bathroom, plunged a fork into his thigh.

In 1935 the doctor sued Mary for a divorce. One of Mary's friends, hearing of the circumstances, suggested lawyer Roland R. Woolley, who accepted the case. Mary did not contest the divorce but filed a countersuit to prevent giving the legal custody of their daughter to Dr. Thorpe.
