The Justice Department study, Kidnapping of Juveniles, found family members committed the greatest number of child kidnappings -- 49 percent. Acquaintances were responsible for 27 percent of the abduction cases, while the remaining 24 percent of abductors were strangers.

The chief judicial concern with the charge of kidnapping is double jeopardy. Double jeopardy is multiple punishment for the same offense, and it is prohibited by the Fifth Amendment to the U.S. Constitution. Kidnapping often is an act that facilitates another offense, such as rape, robbery, or assault. Rape, robbery, and assault often involve the act of moving a person against her or his will, which is the gravamen (significant element) of a kidnapping charge. Thus, a persistent problem with kidnapping prosecutions is determining whether a kidnapping conviction would constitute a second punishment for the same act.

During the search at the kidnapping scene, traces of mud were found on the floor of the nursery. Footprints, impossible to measure, were found under the nursery window. Two sections of the ladder had been used in reaching the window, one of the two sections was split or broken where it joined the other, indicating that the ladder had broken during the ascent or descent. There were no blood stains in or about the nursery, nor were there any fingerprints.
