In early 2003, Incubus became embroiled in a contract dispute with Sony and filed a lawsuit to have their deal terminated under California labor laws. In April, the band announced the departure of bassist Dirk Lance. Within days, fellow Incubus guitarist Mike Eiziger called upon his Time Lapse Consortium mate Ben Kenney to be Lance's permanent replacement. The group remained a part of the Sony empire... and released A Crow Left of the Murder on Epic/Immortal in early 2004, which hit number two on the Billboard Top 200. Some touring followed before Incubus headed home in November to take a well-deserved break. The guys spent the next two years individually exploring things outside of the band -- music, art, film, and literature endeavors all included -- though they also remembered to work on and finish their sixth album, recorded over a year's time in both L.A.

In May 2006, the second Incubus podcast was released via internet. It contained many live covers of other bands, the favorite among many fans being the cover of Alice in Chains' "Would?". It ... stated that many titles for the new album were being considered. Jose Pasillas, Incubus' drummer, jokingly said it could be titled "Jose and the Silhouettes". In November 2006, a third Incubus podcast was released and it featured Brandon and Mike providing commentary to tracks on the album as they listened to it.

Any discussion of Incubus would be incomplete without touching upon some of the bad luck (some would say the "curse") that has plagued the film for over thirty years. The film was shown once commercially in the United States, at a disastrous premiere during the San Francisco Film Festival. A defective print with no soundtrack was accidentally sent. After the correct print was rushed over, members of the Esperanto society heckled the film, jeering at the mispronunciation of some words.
As tipped here last fall, Incubus has penned three new songs for the "Stealth" soundtrack, due July 12 via Epic. "Make a Move" will serve as a radio single and ... appears in the film's trailer. "Stealth," which stars Jamie Foxx, Jessica Biel and Josh Lucas, arrives July 29 in U.S. theaters.

"The songs from Fungus Amongus were recorded when Incubus were all around 18 years old." this is ... incorrect, for even in the cd book itself it says they were between the ages of 15-17.
