Humana's profit margin declined from 2005 to 2006 in both segments, despite rising overall. Falling margins in each sector brought down margins overall, but the increased concentration in the government segment that brough them up, with the second effect outweighing the first. The government sector's declining profit margin is not necessarily ominous, since it accompanied rapid organic growth: Humana grew by taking on new clients, rather than via mergers or acquisitions, which are costly.

Humana is one of hundreds of insurers that together will collect $86 billion in Advantage premiums in 2008. The government could save about $11.2 billion, or 13 percent, if it directly provided benefits to those policyholders, according to official estimates.

Prior to the trial, which began June 13, all the defendants had agreed to out-of-court settlements with the Smelik family, except for Humana. The earlier settlements totaled $602,000. Nonetheless, jurors were required by law to attribute blame for the negligence among all the defendants. Specifically, the jury found that Humana was 35 percent responsible, Mann was 50 percent responsible and Alamo City Medical Group was 15 percent responsible. Campbell was not assessed any blame by the jury.

In the fourth quarter, Humana reduced its medical costs, spending 80.3 percent of premium revenue on doctors and hospitals, down from 83.2 percent a year earlier. In the third quarter of 2007, Humana reported the ratio was 83.8 percent.
