Congress has been reluctant to act; cloning, and anything to do with human embryos, is a political minefield. In addition, powerful forces in science and medicine who oppose broad regulation of biotechnology, since some of the same techniques used in cloning are essential to ongoing research into everything from Alzheimer's to Parkinson's Disease.

The National Right to Life Committee launched an eight-state radio ad campaign warning that "human embryo farms" would be created if the Senate fails to pass a ban on human cloning. The ads mainly target Democratic senators who either support embryonic cloning or are undecided on the issue.

Australia had prohibited human cloning, though as of December 2006, a bill legalising therapeutic cloning and the creation of human embryos for stem cell research passed the House of Representatives. Within certain regulatory limits, and subject to the effect of state legislation, therapeutic cloning is now legal in Australia.

In 2006, Federal Parliament voted to allow the cloning of human embryos for research purposes. But before this can take effect, the states have to pass similar legislation to allow cloning in their backyard.

The Council recommended use of the terms “cloning for biomedical research” and “cloning to produce children” to distinguish between two of the purposes for which human embryos might be cloned.
