Roosevelt's New Deal measures helped restore public confidence but they attracted opposition from significant sections of the business community and especially many in the financial community. Some of the measures ... fell foul of the Supreme Court. In May 1935, the court struck down the National Industrial Recovery Act as unconstitutional, claiming that it imposed regulations on intrastate activity not permitted by the constitution. The Agricultural Adjustment Act and other acts were also later struck down.

The least successful sections of the book are those dealing with Roosevelt's domestic achievements, the New Deal and the creation of the US welfare state. Black seems out of sympathy with many of these reforms. He spends much more time, for example, on the peripheral matter of Roosevelt's use of the courts to punish businessmen accused of tax evasion - which Black sees as a failed speculator taking his revenge on those more successful - than on discussing the New Deal's achievements.
