Bertarelli said he negotiated the changes with the first official ``challenger of record'' -- the Club Nautico Espanol de Vela -- as required by the Deed of Gift. According to Ellison's suit, that club didn't exist until days before it filed its challenge, never held a regatta and ``has simply delegated to the defender the authority to determine all of the `conditions' governing the match.''

A legal battle is currently developping between Larry Ellison of BMW ORACLE Racing, represented by the Golde Gate Yacht Club of San Francisco (GGYC) and Ernesto Bertarelli of alighi, represented by Sociétet Nautique de Genève (SNC). The Management for the next Americas Cup (ACM) is tightly controlled by Bertarelli and Ellison feels that he needs to challenge this.

Ellison, like Bertarelli, is a successful sailor in his own right and raced his maxi yacht Sayonara around the world for many years. In 1998, he won the disastrous Sydney-Hobart race in which six yachtsmen died in appalling conditions.
Whidden says, too, that challengers have chafed under the imperial style of Bertarelli’s ACM. And the use of a compliant Spanish club to do an end run around Ellison? Whidden characterized the stratagem as “questionable,” but says that Bertarelli’s innovative and businesslike approach to the 32nd Cup — stirring up interest with 14 pre-Cup regattas and creating a $637 million village and marina in Valencia as a tourist destination — delivered one of the most exciting and fun events in years. “He does have a track record,” Whidden says. “He put on a great event.”
The dispute started when Bertarelli was found to have broken cup rules by selecting a challenger that failed to meet basic requirements of the game. Spotting the error, the Golden Gate club took Bertarelli to court, where a judge tossed out the phony challenge from the hastily assembled Club Nautico Espanol de Vela and put Ellison's well- established GGYC in its place as official challenger of record.
