Durkheim ... made an association of the kind of solidarity in a given society and the preponderance of a law system. He found that in societies with mechanical solidarity the law is generally repressive: the agent of a crime or deviant behaviour would suffer a punishment, that in fact would compensate collective conscience neglected by the crime—the punishment acts more to preserve the unity of consciences. On the other hand, in societies with organic solidarity the law is generally restitutive: it aims not to punish, but instead to restitute normal activity of a complex society.
Essential to Australian totemic belief, in Durkheim's view, was the idea that the totemic emblem, a design representing the clan's totemic entity, was sacred. Its sacredness lay in the fact that it conferred sacredness on whatever was marked with it.
Durkheim believed that it was these social facts that constrained people?s behaviour. Your options are limited because these social facts give a limit to possible behaviour, they are prescriptive, prohibitions and environmental limitations.
