During that time, she recorded two albums of her songs arranged by Horace Tapscott and backed by the Pan Afrikan Peoples Arkestra. The case of United States vs. Edward and Elaine Brown was not about income taxes. For more than a dozen years, they simply asked the Internal Revenue Service to show them the law that specifically makes them liable to pay the federal income tax, all the while stating that if the government could do so, they would gladly pay all income taxes and never question the law again. Instead, the Internal Revenue Service ignored their requests, year after year, although the Browns were constitutionally entitled to an answer. Then, in 2004, after never responding to any of the Browns’ countless requests, the Internal Revenue Service, along with a SWAT team, US Marshals, state and local police, raided Elaine’s office building and took each of the Browns, by force, into custody.
From an early age, Elaine Brown had a series of adolescent and young-adult love affairs with black and Jewish middle- and upper-class men. In 1965 she left Philadelphia for Los Angeles, where she worked as a cocktail waitress. While there, she met Jay Kennedy, a social activist and a member of the American Comunist Party. Kennedy's radical views were influential in leading Brown towards the Black Power Movement and the Black Panther Party founded in1966 byHuey P. Newton.When Newton in 1974 was indicted for murder and fled to Cuba,heappointed Elaine Brown to runthe Party in his absence.
Elaine Brown, representing herself and her husband, Ed, hand crafted over fifty motions during the course of their trial. All legal experts who read the motions agreed that they were flawlessly written and all within the scope of the law and in accordance with established court procedures. All but a handful of the motions were denied, many without objection from the prosecution or without explanation. The Browns were not allowed witnesses, to present evidence, or to cite case law. The jury was ... instructed to return a verdict based solely on whether or not the Browns paid federal income taxes or filed tax returns for the years in question. Also, the Browns were technically not charged with a crime, they were charged with two penalty clauses.
Elaine Brown : Ask people about racism in the US and many of its citizens will say it's a thing of the past. People of color have equal opportunity and, if anything, there is now reverse discrimination. But how do we explain the marked difference in college attendance between whites and non-whites? The extremely disproportionate rates of incarceration of black men? Racial profiling by law enforcement? Labeling young males in our ghettos as superpredators? And the acceptance of the so-called fact that "they" are just different than the majority "we." Easy to justify when speaking from a position of privilege, be it skin color, gender or economic status. Elaine Brown has found a disturbingly insidious nature to racism today. A racism whereby middle class whites and blacks alike are quick to condemn an accused man whose only crimes may be that he's poor and not white. Today, as an activist, writer and popular lecturer, Brown upholds the original vision of the Panthers and the survival programs they developed like the Free Breakfast Program for Children, free health clinics, Senior Services, among others. She lectures on the vision of an inclusive and egalitarian society, focusing on resolving problems of race, gender oppression and class disparity in the United States.
