This is particularly obvious in Cherry's case; abstracted from his contexts, Don Cherry's style was in a real sense grounded in bebop. He wasn't an especially strong bebop player by classic standards -- his range and facility were somewhat limited, for one thing -- but externally, his style bore the marks of modern jazz in terms of melody, harmony, rhythm, and phrasing.

As for Shan and Cherry, they too are guilty of bad judgement, but they are not criminals. Even if one believes Cherry is guilty of celebrity influence peddling, his actions are not technically illegal.

In the moment every one was waiting for, Cherry then broke out with his signature smash hit, Band of Gold. Recorded in October 1955, and released two months later, Band Of Gold shot up to the Number 5 spot on Billboard's Top 20 Chart in January 1956, staying in the Top 20 until March where it peaked at Number 12.

In 1952 Irving Berlin heard Don's recording of "Maybe It's Because" and invited Don to his office. He proceeded to tell Don that it was one of the best recordings he heard of his songs, and that it had prompted him to write a country song just for Don. Unfortunately it wasn't one of Mr. Berlin's best songs, but the mere fact that he had composed it strictly for Don overshadowed its flaws.
