Executive clemency exists to afford relief from undue harshness or evident mistake in the operation or enforcement of the criminal law. The administration of justice by the courts is not necessarily always wise or certainly considerate of circumstances which may properly mitigate guilt. To afford remedy it has always been thought essential in popular governments...to vest in some authority other than the courts power to ameliorate or avoid particular criminal judgments. 33

Do not do or say anything which could be interpreted as resisting law enforcement, as that could result in an additional criminal charge, one taken very seriously by the courts. Stay as calm as possible and try to remember exactly what happened before, during, and after the arrest. Cooperate with the officers in such things as getting into and out of the car and walking, but save your questions and explanations for your attorney.

If someone is charged under criminal law, an indictment is made against the alleged offender. At this point, grand juries or even the Supreme Court may become involved depending upon the nature of the crime.
