Criminal law involves prosecution of a person by the government, as the representative of the people of society, for an act that has been classified as a crime. Criminal law differs from civil law in many aspects, including the parties involved, the outcome that is sought, and the standard of proof required. In a criminal case the state, through a prosecutor, initiates the suit, while in a civil case, the injured party brings the suit. Crimes are punishable by incarceration, fines, or both, whereas a person found civilly liable may only be forced to pay money or surrender property. Crimes generally require a showing of wrongful intent, while the focus of a civil case is upon fault, regardless of intent.

In May 2007, the Berkeley Center for Criminal Justice hosted Boalt Hall's first criminal law symposium. BJCL will be editing and publishing the scholarship showcased at the symposium in a new Symposium Issue in Fall 2007. BCCJ plans to continue hosting a symposium each summer, and BJCL will publish the resultant scholarship in a corresponding, annual Symposium Issue.

Criminal law alsodeals withproblems associated with probation or parole, or requests for record sealing or expungement of records. Crimes can be broken into many general categories such as personal crimes, white-collar crimes, and nonviolent crimes. Personal crimes include homicide, assault and battery, domestic violence, and abuse. White-collar crimes usually refer to tax evasion, RICO (racketeering), securities fraud, and sometimes, environmental violations. Non-violent crimesinclude drug crimes, gun possession and burglary.
