Criminal Background Check: Individuals
built 629 days ago
Criminal background check information should not be kept in an individual’s personnel file. For current employees, this information should be kept in a separate file. For applicants who are hired, criminal background check information should be kept in the recruitment file for that position. If someone is not hired, it is ok to keep all of the information in one file. Visit the following OHR web site for other questions and answers about staff employee personnel files including a list of items that do not belong in the personnel files of an employee: http://hrweb.berkeley.edu/tools/pfileqa.htm.
When you conduct the criminal background check you will find out the individual’s phone numbers, address history, criminal and civil records, aliases, marriage records, neighbors, and more. The information you are able to provide for the check will affect what information you receive. You must have at least the individual’s name, address, maiden name, or social security number to begin the check. Once you enter at least one of these things the search will begin. Usually court records, utility company records, change of address records, business records, property records, and other public records are searched. Then, you will receive the information you are looking for.
Background checks are only as accurate as the criminal records. For example if the criminal court records in a county contain inaccurate or incomplete information on an individual, then the information that you receive on that individual will ... be inaccurate. When you run a check Volunteer Select Plus will ask for addresses and other information on the person you are checking to aid in the identification process and to help ensure that any conviction records on that individual are accurate. That said, you will sometimes receive conviction records that will require you to ask additional questions of the individual to verify information and ensure that the record is on that person.

Lots of people feel that conducting a criminal background check on the people they are close to or people they are considering being close to is akin to a crime, or at the very least dishonest. If you can’t trust someone why are you close to him or her? And, if you are considering being close to someone shouldn’t you be able to tell on your own whether they are trustworthy or not? The fact of the matter is that the majority of people are good and honest individuals. But, there are those bad apples out there who know how to manipulate you to make you believe they are good when in fact they have a very dark history. You must protect yourself and conducting a criminal background check is a great way to do so. You will find out whether you have a need to worry or not and then can move on with your life.
The UCPD will keep the criminal background check results on file at their office indefinitely or until they are notified by a department that an individual has left campus employment. When an employee leaves the campus and is not expected to return, departments can send an email to UCPD notifying them that the individual has left University employment. The UCPD Records Unit will destroy records after an employee leaves and notify DOJ to discontinue the updates. Departments can send the email to this UCPD address: fingerprints@lists.berkeley.edu.
Consent Form - Prior to conducting a criminal background check, UWP will have the candidate sign a consent form. This form will specifically ask a candidate to self-disclose if he or she has ever been convicted of a crime or is currently facing criminal charges. Individuals who decline to sign the consent form will no longer be considered a candidate for the vacancy. A candidate will submit the consent form directly to Human Resources where it will be maintained in confidence to the extent permitted by the Wisconsin Public Records Act and other applicable laws.
