Class Action Lawsuits: States
built 213 days ago
The Ritalin Class action lawsuits were a series of federal lawsuits in 2000, filed in five separate U.S. states. All five lawsuits were dismissed by the end of 2002. The lawsuits alleged that the makers of Methylphenidate (Ritalin) and the American Psychiatric Association had conspired to invent and promote the disorder ADHD to create a highly profitable market for the drug. The lawsuit ... alleged that CHADD (Children and Adults with Attention Deficit/Hyperactivity Disorder) deliberately attempted to increase the supply of Ritalin and ease restrictions on the supply of Ritalin to help increase profits for Novartis.
This is the first class action to go to trial on the issue of whether managers spent over half their work time engaged in exempt work under California law. The case, which was the subject of articles in Business Week, CFO Magazine, The Los Angeles Times and The Los Angeles Daily Journal, was closely followed by the employer's bar and lobby. The result implicates the common practice throughout the state of classifying as "exempt" employees who work on the sales floors and production lines.

The lawsuit, filed on behalf of 1.1 million smokers in Illinois, is the first class-action light cigarette case to reach trial. With similar suits pending against Philip Morris, R.J. Reynolds Tobacco Holdings Inc. and British Tobacco Plc's Brown & Williamson in other states, investors and analysts have expressed concern that an Illinois loss may lead to a series of expensive judgments.

Since 1938, many states have adopted rules similar to the Federal Rules of Civil Procedure (the law governing class-action lawsuits). However, some states like California have homegrown civil procedure codes which they have been reluctant to abandon.
The class action suit is seeking a complete overhaul of the Oklahoma DHS. The children’s advocacy group that helped bring suit is Children’s Rights, a New York based organization that lobbies for the rights of children all over the nation.  According to Children’s Rights, mistreatment of children in the care of the state of Oklahoma has been among the worst in the nation for the past five years.  The suit claims that foster children in Oklahoma experience four times the abuse than is the national norm, and further, the rates of abuse exceeded the rates of abuse and maltreatment among the general population of Oklahoma. In essence, they claim that children in foster care were subjected to more frequent episodes of abuse than children who were not in the welfare system.
