DVD-by-mail service Netflix found itself on the receiving end of a class-action suit when California resident Frank Chavez discovered that, despite valiant efforts, he was unable to get truly unlimited monthly rentals. Chavez had stumbled onto the practice of "throttling," whereby users who watch more than a certain amount of movies each month find themselves waiting longer for new discs to arrive in the mail. This, depending on your perspective, is simply A) good business or B) nefarious attempt to screw the consumer.

Swiss law does not provide for any form of class action. When the government proposed a new federal code of civil procedure in 2006, replacing the cantonal codes of civil procedure, it rejected the introduction of class actions, arguing that:
[I]n 2006, the firm filed just 17 class-action lawsuits, according to a tally of its press releases on Business Wire and PRNewswire. That is down from 36 in the second half of 2005 and 55 in the first half. Milberg Weiss has announced no new lawsuits since the indictment.
