Civil Liberties: United States
built 186 days ago
Since the mission of the ACLU is to protect civil liberties, that includes not only litigation, but ... legislative lobbying and public education. Maintaining contact with state legislators and providing testimony on proposed legislation is an effort of state affiliates to minimize civil liberties infringement in new laws. In NC that is one of the time-consuming responsibilities of the executive director, Jennifer Rudinger. The ACLU is better known for litigating, since that is what the media focuses on, but it’s far less costly to head off potential violations while they’re still potential--hence the time spent monitoring state legislatures.

As promised in Library Friends Network Vol. 1, No. 8, FCNL's web site now includes a compilation of current legislation about civil liberties matters. There are summaries of legislation designed to restore and protect civil liberties and of legislation introduced to advance President Bush's new initiatives, which expand law enforcement authority to the detriment of civil liberties in the United States. Here's the direct link to the compilation: http://www.fcnl.org/issues/item.php?item_id=519&issue_id=67.

Nelson issued a statement through the Kucinich campaign explaining his position: “Dennis Kucinich is a strong defender of the Constitution, the national security, and the civil liberties of the American people. He’s right to challenge a blind loyalty oath to the Democratic Party because it’s un- American. The irony is that the state Party is trying to exclude him from the ballot even though he’s the one Democrat who’s been the most loyal to this country and to what the Democratic Party should stand for. Dennis’s loyalty is to the Constitution of the United States and to the American people — not to the Texas Democratic Party.”

Republics or democracies such as the United States have a Constitution, a bill of rights and similar constitutional documents that enumerate and seek to guarantee civil liberties. Other states have enacted similar laws through a variety of legal means, including signing and ratifying or otherwise giving effect to key conventions such as the European Convention on Human Rights and the International Covenant on Civil and Political Rights.

That Lincoln emerges from the perennial controversy that afflicted his Administration over civil liberties with a reputation for statesmanship may be the most powerful argument for his judicious application of executive authority during a national emergency. As historian Don E. Fehrenbacher has noted, "Although Lincoln, in a general sense, proved to be right, the history of the United States in the twentieth century suggests that he brushed aside too lightly the problem of the example that he might be setting for future presidents."31

Lee Rowland of the Nevada ACLU says the law gives fetuses civil liberties that are not in concert with rights to choice. She says it's akin to the state recognizing a separate legal entity.
