"Circumcision is a divine commandment. It's not an optional kind of thing and it doesn't depend on logic," CJC communications director Rubin Friedman said. If a child is not healthy, the only exception would be delaying the rite, usually performed on the eighth day following birth, he said.

Circumcision must, whenever possible, take place on the eighth day, even when this falls upon the Sabbath (Shab. xix. 1); Samaritans and the Karaites dissent from this rule. However, if by reason of the child's debility or sickness the ceremony is postponed, it can not take place on the Sabbath (Talmud Shabbat 137a). It is the duty of the father to have his child circumcised; and if he fails in this, the bet din of the city must see that the rite is performed (Talmud Kid. 29a).

Circumcision is so important that it may be performed on the Sabbath or a holiday, despite prohibitions of drawing blood on those days. Yet the ceremony may be postponed for health reasons, and then it cannot be performed until seven days after a physician has declared the child healthy. If this occurs, the rite cannot be performed on the Sabbath or holiday, because there is no longer sufficient reason to violate the general law of the holy days.

The brit mila (ritual circumcision) is always held during the eighth day after the child is born, even if the eighth day occurs on Shabbat or a holiday. A baby born on Monday morning or afternoon will have his brit on the next Monday. But a baby born on Monday night will have his brit on the following Tuesday since, according to the Hebrew calendar, a new day begins after sundown.

Some question the apparent inconsistency of allowing male circumcision but prohibiting female genital cutting [18]. Some assert that circumcision may cause emotional scarring later in life, or urge that the procedure should be left until a man is mature enough to make the choice for himself. Others assert that circumcision is less traumatic when performed in infancy and point out that it may disturb some religious communities and interfere with the traditional right of parents to make this decision on behalf of their child.

The principle underpinning the law-proposal is that the child's best interest should be the determining factor in deciding whether a circumcision is to be performed or not permitted. The government's law-proposal ... suggests that only people holding special permits from the National Board of Health and Welfare - except personnel of the health care system - be allowed to perform the operation.
