A former top official in China's ruling Communist Party has launched a stinging attack on his former colleagues as a key political meeting winds down in the capital. Bao Tong, former aide to ousted late premier Zhao Ziyang, was scathing about the 17th Party Congress. He wrote this essay, which was broadcast by RFA's Mandarin service, from his Beijing home, where he has lived under house arrest since his release from jail in the wake of the 1989 student movement.

China suffered through clashes with European powers in the 1800s. Then, in 1911, Chinese revolutionaries overthrew the last dynasty. The country suffered internal strife for nearly four decades due to warlords, civil war and Japanese invasion. In 1949, the Chinese Communist party won the civil war and established China's current government.

China has not ratified core International Labor Organization conventions on freedom of association and collective bargaining, but has ratified conventions prohibiting child labor and employment discrimination. Apart from banning independent unions, Chinese labor laws meet international labor standards, and the Chinese Government is in the process of preparing legislation to improve workers rights protection. However, enforcement of existing labor regulations is poor. Some FIE’s have faced negative publicity arising from labor disputes related to domestic partners or suppliers.

Although China has revised many laws and regulations to conform to WTO investment requirements, in practice, Chinese industrial planners “encourage” investments that meet economic development goals. U.S. companies are concerned that “encouragement” may amount, in many cases, to WTO-prohibited requirements, particularly in light of the high degree of discretion provided to the Chinese officials who review investment applications. For example, according to U.S. firms, some Chinese officials still consider export performance and local content when deciding whether to recommend approval of a Chinese bank loan, which is often essential to a foreign direct invested (FDI) project’s success.

In 1997 Hong Kong was transferred from Britain to China under an agreement that gave the region considerable autonomy. Portugal recognized Macao as Chinese territory in the late 1970s and negotiated the transfer of Macao’s administration from Portugal to China in 1999. Macao, too, was guaranteed a special degree of autonomy.
