Capital punishment ought to be administered with absolute fairness. Neither race, money, influence, nor any other trivial factor should have any influence upon the facts of the case. If there is any doubt about a man’s guilt, grant him the benefit of that doubt, and spare his life.
Like the deterrence argument for capital punishment, this seems to be the wrong kind of argument. Punishment is punishment and treatment is treatment, and one must not be substituted for the other. Some persons who violate the law are, without doubt, mentally ill. It is unreasonable and inhumane to punish them for acts which they may not have realized they were doing; to put such a person to death would be an even more grievous wrong. In such cases treatment is called for.
In his prophetic encyclical, "The Gospel of Life," he taught that capital punishment should only be used when it is impossible to defend society in any other way. And he added this key sentence: "Today... as a result of steady improvement in the organization of the penal system, such cases are very rare if not practically nonexistent."
