Heeding the call of another entrepreneurial opportunity, Mr. Atkins left Warner Bros to become the founding CEO of a media start-up company called Mediaconnex. Mediaconnex provided cable and television networks with technology and services that maximized marketing efforts, programming expenditures, and sales revenues. As CEO, Mr. Atkins was responsible for raising the companyís venture capital funding, developing key patented product technologies, and recruiting over 150 charter customers, including Warner Bros., the Hispanic Television Network, and the American Independent Network. Having developed a revenue pipeline and customer base four times that of the initial funding benchmarks, Mr. Atkins moved on to his next opportunity.

In an effort to revive sales, Atkins will run a four-page newspaper insert in January featuring coupons for its entire product line. In-store efforts include aisle banners and shopping cart ads that highlight the taste of Atkins products. Other product-centered print is likely, and Atkins could increase the budget depending on sales.

Speaking of informal SEC guidance, Atkins said that the pronouncement of SEC accounting staff can have a significant impact and can affect the market. He pointed to Staff Accounting Bulletin (SAB) 101, on revenue recognition, as an example of staff guidance that was not formalized by the commission through a notice and comment process. Atkins suggested to reporters after his speech that the substantive issues of SAB 101 should have been handled by the commission as a rulemaking. There is a need for notice and comment because of litigation risk as well as to provide a basis for an enforcement action, he said.

An Atkins spokesman declined to comment on the shift, noting only that the company will distribute a multi-page free-standing insert in newspapers nationally on Jan. 2. But an executive with knowledge of the situation said the budget correction is a result of ''acting responsibly.''
