The Australian registered motor tanker Arthur Phillip was on a voyage from the Saladin oil terminal, West Australia, to Botany Bay, New South Wales, with a full cargo of crude oil. At about 2325 (UTC+9½), 5 May 1991, in approximate position 037 degrees 31 minutes South 132 degrees 59 minutes East, the fire alarm sounded and the bridge alarm panel indicated a fire in the accommodation block at main deck level. A fire was confirmed in the crew recreation room/bar. The master altered course to bring the Arthur Phillip closer to another vessel, the Alcides, in the event that assistance may have been required.

According to the Justices, Arthur Phillip had incorrectly applied the Doctrine of Terra Nullius, thereby failing to recognize Aboriginal legal systems. This failure to recognize the legal systems amounted to an act of racism that needed to be addressed. To address the racism, the Justices ruled that if Aborigines can produce 200 years of evidence showing their association with the land, then they can formerly claim title. If Aborigines have lost an association at any time in the last 200 years, irrespective of the reason, then title can not be revived.

Arthur Phillip was born in 1738 in London, the son of Jacob Phillip, a language teacher who came from Frankfurt, and Elizabeth, nee Breach. He attended the Greenwich school for the sons of seamen and was apprenticed to the Merchant Navy, graduating in 1755, after two years at sea. He transferred to the Royal Navy and was promoted to lieutenant in 1762 before being retired in 1763 when the Seven Years War ended.
