At the time of the serving, Apple Computers was embroiled in a trademark case against Apple Records, the record distribution label started by the Beatles. That case was recently settled, and both can use the name Apple without confusing consumers, even though both are technically in the business of music distribution. Apple records, incidentally, uses a green MacIntosh apple as its logo, not to be confused with the Macintosh Apple computer, made by the other Apple, the one that makes computers.

When Apple Computers first came into existence, the Beatles' lawyers sued -- and won -- over the use of the corporate name. The Fab Four, it was widely known, already had their own company called Apple Corps. (Ironically, Jobs admitted to naming his company as a tribute to the Beatles.) The result of the suit was a huge cash settlement and a promise that the Apple logo and name would only be used for computers -- and never for a music company.

Apple made $1 billion last quarter, Dell made $673 million. Heck, HP is #1 in the PC world right now and they made $1.5 billion (partially because of excellent printer sales). Apple seems to know what they are doing.
