Age of Consent: Sexual Activity

The purpose of age of consent legislation is to protect vulnerable young people from sexual exploitation and abuse, but there is no clear justification for a differential age for homosexual male activity and other sexual activity. Although homosexual experimentation may be quite common among adolescent boys (despite the present law), extensive recent research does not indicate that men aged 16-21 are in need of special protection because they may be "recruited" into homosexuality. Unwelcome sexual attentions of a seriousness warranting criminal prosecution are equally offensive whether the victim is a man or a woman: the same law should therefore apply to all.

The age of consent in North Carolina in general is 16, though no school faculty member can have any sexual activity with any student more than 4 years their junior except when married to the person {§14‑27.7}. Any sexual intercourse with a 13-15 year old is prohibited unless the defendant is less than 6 years older than the victim except when married to the person {§14‑27.2, 14‑27.4 & 14‑27.7A}.

The Canadian Federation for Sexual Health believes that the age of consent should be universal, without regard to gender or type of sexual activity. The current law makes discriminatory distinctions among various types of sexual activity that are not supportable on health or other objective grounds. Furthermore, the distinction is a barrier to comprehensive sexual health education.

The cognitive maturity that rapidly develops between about the ages of 11 and 14 is deemed sufficient to enable many young adolescents to consent to their own medical treatment. It is reasonable to assume that the mature adolescent can ... make decisions about whether they want to engage in sexual activity.
